FLORIDA REAL ESTATE SALES ASSOCIATE COURSE

Title, Deeds And Ownership Restrictions

Section 15 of 39

Adverse Possession continued: The Timeline (7 Years) In Florida, the squatter must occupy the land and pay taxes for 7 continuous years. If the true owner shows up on Year 6, Day 364 and kicks them off, the clock resets to zero. Why does this law exist? It encourages land use. The law prefers someone who uses, improves, and pays taxes on the land over an owner who ignores it for nearly a decade. If you see a fence that looks like it is over the property line, warn your buyer! If that fence stands for 7+ years and the neighbor pays taxes on that strip (unlikely for just a fence, but possible), they could legally claim that slice of the yard.
