The Commercial Real Estate Sales Commission Lien Act(Chapter 475, Part III, F.S.)As a new agent, you need to understand that getting paid isn't always guaranteed, even if you did the work. In the past, commercial brokers would spend months putting a massive deal together, only for the seller to refuse to pay the commission at the closing table. The broker would have to sue the seller later—often after the seller had already taken the money and left the country.To fix this, Florida created a special law to protect Commercial Brokers.The Big Rule: Commercial Properties Only!You CANNOT put a lien on a house just because the seller didn't pay you. If a seller refuses to pay your commission on a home sale, you have to sue them in court like any other debt. You cannot stop the closing or cloud the title.Commercial Property: You CAN file a lien, but only if you follow specific rules.
