Devise is the specific legal word for gifting Real Property (land, houses, condos) through a will. You don't "bequeath" a house; you "devise" it.Devise = Dirt” - Both words start with D. If it sits on the dirt or is the dirt itself, it is a Devise.The Receiver: The person getting the house is called the Devisee.Think: "The Devisee gets the Dirt."Analyzing the Sentence:"The Testator devised the family farm to his son."Testator: The father who wrote the will.Devised: The legal act of giving the real estate.Family Farm: The Real Property (The "Dirt").Son: The Devisee.Analyzing the Sentence:"The Testatrix left a bequest of her diamond ring to her granddaughter."Testatrix: The female who wrote the will.Diamond Ring: The Personal Property (The "Belonging").Granddaughter: The Beneficiary.If a client tells you, "My uncle left me this house in his will," legally speaking, they are the Devisee and the house is a Devise. You are helping them sell the property they acquired through voluntary alienation.
