Easements "The Right to Trespass". An easement is a legal right to use someone else's land for a specific purpose. You don't own the land, you just have a right to cross it.Types of Easements:(a) Appurtenant: This involves two properties next to each other.Servient Tenement: The land being used (The "Server").Dominant Tenement: The land that benefits (The "Dominator").This easement "Runs with the Land." If the Dominant owner sells, the new owner keeps the right to cross.(b) In Gross: This involves a person or company, not a neighboring land.Example: The Power Company has an easement to put lines across your backyard. It benefits the company, not a specific plot of dirt.
