If the "Note" is the handshake deal, the "Mortgage Contract" is the rulebook that keeps that deal alive. These provisions protect the lender’s money and the property itself.The "House Rules" (Important Mortgage Provisions)Think of these as the ongoing maintenance requirements for the loan. If the borrower ignores these, they are technically in default, even if they are making their monthly payments!Promise to RepayThe Rule: This reiterates the pledge made in the Promissory Note.Plain English: "I promise to pay you back the principal plus interest, on time, every month." It is the foundation of the entire relationship.Taxes and LiensThe Risk: In most places, if you don't pay your Property Taxes, the local government can seize your house. Crucially, the government gets paid before the bank.The Rule: The borrower agrees to pay all taxes and assessments on time. If they don't, the lender might step in, pay them, and charge the borrower (or foreclose).
