Fixtures: The Gray Area. When Personal Becomes Real. This is where it gets tricky. A Fixture is an item that used to be personal property but has been attached to the land or building in such a way that it is now legally considered Real Property.When you buy a ceiling fan at Home Depot, it is in a box. It is Personal Property. You put it in your trunk and drive home. Once you wire it into the ceiling and screw it into the joist, it becomes a Fixture. It is now part of the house.The Rule: If you sell the house, the fixture stays. You cannot take the ceiling fan with you unless you explicitly exclude it in the contract.
