Selling Tenant-Occupied Homes. Does the Tenant Have to Move? This is a classic question. A landlord sells a house that currently has a tenant with a valid lease. The lease survives the sale. The new owner buys the house "Subject To" the lease. They step into the shoes of the old landlord. Can they kick the tenant out? NO. The tenant stays until their lease expires. The old landlord must transfer the security deposits and advance rents to the new owner. It is illegal for the old landlord to keep the deposit.
