If an asset is held for one year or less, any profit is a Short-term Capital Gain and is taxed at the investor's ordinary income tax rate (which is usually higher). If held for more than one year, it is a Long-term Capital Gain, which is taxed at a lower, preferential rate (typically 0%, 15%, or 20%).The installment sale method allows a seller to spread the tax liability over multiple years. If the seller provides financing (seller financing) and receives payments over time rather than a lump sum, they only pay tax on the portion of the profit they actually receive in that specific tax year. This prevents the seller from being hit with a massive tax bill in year one when they haven't received all the cash yet.Section 1031 of the tax code allows an investor to sell an investment property and buy another "like-kind" investment property without paying capital gains taxes immediately. This is not a tax-free sale; it is tax-deferred. The capital gains tax is rolled over into the new property and will eventually be paid when the investor sells the final property for cash. This allows investors to trade up to larger properties without losing equity to taxes.
