Every real estate company (whether it's an LLC, Corporation, or Partnership) must be registered with the DBPR (Department of Business and Professional Regulation). Every company must have at least one Active Broker attached to it. This person is called the "Qualifying Broker." They are the one responsible for everything the company does.The Crisis: Losing the Only Broker - Sometimes, emergencies happen. The only active broker might die, quit unexpectedly, or become incapacitated.Immediate Action: The company must notify the FREC (Florida Real Estate Commission) immediately. The company has exactly 14 calendar days to find a replacement Captain.Can We Keep Working? (The Freeze) - During this 14-day emergency period, business is restricted: New Business = STOP: You cannot take new listings, write new contracts, or start new deals.Old Business = GO: You can continue managing deals that were already in progress (like a closing scheduled for next week) so that your current clients aren't hurt by the broker's absence.
