C. Title Opinion. "The Danger Zone for Agents". This is a critical compliance issue for you as a licensee. A lawyer reviews the Abstract of Title and issues a "Title Opinion" stating whether the title is marketable (clean).Under Chapter 475.25, F.S., real estate licensees are NOT qualified to give an opinion on title. You must never tell a buyer, "I checked the records, and the title looks fine." You are not a lawyer. If you are wrong, you can be sued and lose your license. If a buyer asks about the title, you are required by law to advise them to either: Consult an attorney to get a formal Title Opinion, ORObtain Title Insurance.
