Not everyone can claim this money. The state blocks certain people to prevent abuse. Spouses: You cannot sue your husband or wife and then ask the state to pay you. The spouse of the offending licensee is ineligible.Another Licensee: If you are a real estate agent involved in the deal (e.g., the listing agent sues the buyer's agent), you cannot claim from the fund. This fund is for the public, not for industry insiders fighting each other.Claims Against Entities: You cannot make a claim against a brokerage company (e.g., "Sunshine Realty, Inc."). You must get a judgment against the individual licensee (the human being).
