To make this deal happen legally, you must "step down" from your high-level fiduciary role and become a Transaction Broker (the neutral referee). This allows you to facilitate the transaction for both parties without playing favorites. However, you can't just make this switch secretly. Because the client originally hired you for loyalty, you need their permission to change the rules of engagement.The law requires a very specific process for this transition. You cannot simply tell the client, "Hey, I'm neutral now." You must get their written consent - You must present the Consent to Transition to Transaction Broker notice. This document clearly lists the duties the client is losing (like Loyalty and Obedience) and the new limited duties they are gaining.The principal must sign or initial this document. If they refuse to sign it, you cannot transition. You would have to remain a Single Agent for the seller and tell the buyer to find another agent (or work with the buyer as a non-represented customer).
