Leaving a job ends your employment, but it does not end your secrets.The Rule: Your fiduciary duty of Confidentiality survives the termination of your employment.Example: If you represented a seller at your old firm and knew they were desperate to sell, you cannot use that secret information against them at your new firm. You must take those secrets to the grave, even if you hate your old boss.The "Listings" Belong to the Broker - This is the most common way agents get sued when changing jobs. You might think, "I found these clients, so these are my files." Wrong. Legally, all listings and transaction records belong to the Broker, not the sales associate.
