The consumer must sue the licensee in a civil court, win a Final Judgment, and attempt to collect the money. Only if the licensee has no assets can the consumer turn to the Recovery Fund.The Limits (How much can you get?) The fund is not a bottomless pit. Compensatory Damages ONLY: The fund pays only for actual money lost.What it covers: The $10,000 deposit the broker stole. What it does NOT cover: Punitive damages (pain and suffering), treble damages, or attorney’s fees. The Dollar Caps: $50,000 per Transaction: The maximum payout for a single deal is $50,000, regardless of how many people lost money.$150,000 per Licensee: The maximum payout for one licensee's entire career is $150,000. If a broker scams 100 people, the fund stops paying after the total hits $150k.Funding: Where does the money come from? It comes from fees and fines paid by licensees, not from tax dollars.
